Booking terms and conditions

 

 

1.  Introduction

These Booking Terms and Conditions (“Terms”) govern all bookings made with Afrikan Accent Adventures (“the Company,” “we,” “us,” or “our”), a tour and travel company registered in the Republic of Kenya. By making a booking with us — whether directly, through our website, by email, by telephone, or through an authorised agent — you (“the Client,” “you,” or “your”) acknowledge that you have read, understood, and agreed to be bound by these Terms.

The person making the booking (the “Lead Client”) does so on behalf of all persons named in the booking and confirms that they are authorised to accept these Terms on behalf of the entire travelling party. The Lead Client must be at least 18 years of age.

2.  Booking Process & Confirmation

2.1  A booking request may be made via our website, email, telephone, or in person. All bookings are subject to availability at the time of confirmation.

2.2  A booking is confirmed only once both of the following have occurred:

    • We have received the required deposit (see Section 3); and

    • We have issued a written Booking Confirmation and/or invoice to the Client.

2.3  Please check your Booking Confirmation carefully upon receipt. Any errors or discrepancies must be reported to us within 48 hours. We cannot accept responsibility for errors not reported within this period.

2.4  All quotations issued prior to confirmation are valid for 14 days unless otherwise stated, and remain subject to the availability of accommodation, park entry, transport, and third-party services at the time of confirmation.

3.  Deposits & Payment Terms

3.1  Deposit.  To confirm a booking, a non-refundable deposit of 30% of the total tour price is required, unless otherwise stated on your invoice.

3.2  Balance.  The remaining balance is due no later than 60 days before the commencement date of your safari or tour.

3.3  Late Bookings.  For bookings made within 60 days of departure, the full tour price is payable at the time of booking.

3.4  Non-Payment.  If the balance is not received by the due date, we reserve the right to treat the booking as cancelled by the Client, in which case the cancellation charges in Section 5 shall apply.

3.5  Payment Methods.  Payment may be made by bank transfer (SWIFT/EFT), credit or debit card, M-PESA, or such other method as we may advise in writing. The Client is responsible for all bank charges, card processing fees, and currency conversion costs unless otherwise agreed.

3.6  Currency.  Prices are quoted in US Dollars (USD) and/or Kenya Shillings (KES) as indicated on your invoice. Where payment is made in another currency, the exchange rate applied by our bank on the date of receipt shall apply.

3.7  Peak Season & Special Bookings.  Certain bookings — including gorilla and chimpanzee trekking permits, Christmas, New Year and Easter travel, migration-season camps, and air or rail tickets — may require full, non-refundable payment at the time of booking. This will be clearly indicated on your quotation or invoice.

4.  Prices & Price Changes

4.1  Our prices are based on costs, taxes, park fees, permit fees, exchange rates, and fuel prices in effect at the time of quotation.

4.2  We reserve the right to adjust the price of unconfirmed bookings at any time.

4.3  After confirmation, we reserve the right to pass on increases arising from factors beyond our control, including:

    • Increases in national park, reserve, or conservancy entrance fees;

    • Increases in government taxes, levies, or permit fees;

    • Significant currency fluctuations (in excess of 5%);

    • Fuel surcharges imposed by airlines or transport providers.

4.4  Where any such increase exceeds 10% of the total tour price, the Client may cancel within 7 days of notification and receive a refund of all monies paid, less any non-refundable third-party costs already incurred.

4.5  Prices include (unless stated otherwise): accommodation as specified; transport in a safari vehicle with an English-speaking driver-guide; park and reserve entrance fees for listed activities; meals as specified in the itinerary; and airport transfers where stated.

4.6  Prices exclude (unless stated otherwise): international and domestic flights not itemised; visa and eTA fees; travel insurance; tips and gratuities; drinks; laundry; items of a personal nature; optional activities such as balloon safaris; and any item not expressly listed as included.

5.  Cancellation by the Client

5.1  All cancellations must be made in writing (email is acceptable) by the Lead Client and take effect on the date we acknowledge receipt.

5.2  The following cancellation charges apply, calculated as a percentage of the total tour price:

30 days or fewer, or no-show 100% of total tour price

5.3  Regardless of the above, any costs already irrecoverably committed to third parties on your behalf — including gorilla and chimpanzee permits, air and rail tickets, and non-refundable camp or lodge deposits — are 100% non-refundable at any time.

5.4  We strongly recommend that all Clients purchase comprehensive travel insurance with cancellation cover at the time of booking (see Section 10).

5.5  Cutting a Tour Short.  No refund will be made for any unused portion of a tour once travel has commenced, including where the Client voluntarily leaves the tour, is unable to continue due to illness, or is required to leave due to unacceptable conduct (see Section 13).

6.  Amendments by the Client

6.1  Requests to amend a confirmed booking — dates, accommodation, party size, or itinerary — must be made in writing by the Lead Client.

6.2  We will make reasonable efforts to accommodate amendments, subject to availability. An administration fee of USD 50 per amendment may apply, in addition to any change in price and any charges imposed by third-party suppliers.

6.3  Amendments requested within 60 days of departure may be treated as a cancellation and rebooking, in which case the charges in Section 5 shall apply.

6.4  Name Changes & Transfers.  If a member of the party is prevented from travelling, the booking may be transferred to another suitable person, provided we are notified at least 30 days before departure and all supplier-imposed costs are met by the Client. Certain permits and air tickets are strictly non-transferable.

7.  Cancellation or Changes by the Company

7.1  We will make every effort to operate all tours as advertised. However, itineraries in East Africa may be affected by factors beyond our control, and we reserve the right to make changes where necessary.

7.2  Minor Changes.  We may make minor changes to your itinerary — such as substituting accommodation of a similar or higher standard, adjusting the order of activities, or altering routes — without liability, and will notify you as soon as reasonably possible.

7.3  Significant Changes.  If, before departure, we are compelled to make a significant change (a change of destination, a material downgrade in accommodation category, or a change of departure date), we will notify you promptly and you may elect to:

    • Accept the changed arrangements;

    • Accept an alternative tour of comparable standard where available, paying or receiving a refund of any price difference; or

    • Cancel and receive a full refund of all monies paid to us, less any irrecoverable third-party costs.

7.4  Cancellation by Us.  If we cancel your tour for reasons other than your default or Force Majeure, you will receive a full refund of all monies paid to us. This shall constitute the full extent of our liability, and we shall not be liable for consequential losses such as visa fees, vaccinations, or independently booked flights.

7.5  Force Majeure.  We shall not be liable for any failure to perform, change, or cancellation arising from circumstances beyond our reasonable control, including war or threat of war, terrorism, civil unrest, industrial action, natural disasters, flood, drought, fire, epidemic or pandemic, government action or travel restriction, border, airport or airspace closure, adverse weather, and wildlife-related events. In such cases, refunds shall be limited to amounts recoverable from suppliers, and we may at our discretion offer a credit note or postponement.

8.  Passports, Visas & Entry Requirements

8.1  It is the Client’s sole responsibility to ensure that all members of the party hold valid passports (with at least six months’ validity beyond the return date and sufficient blank pages), visas, electronic travel authorisations such as the Kenya eTA, and any other documents required for travel.

8.2  We may provide general guidance on entry requirements as a courtesy. Such information does not constitute legal advice, and requirements may change without notice. Clients should verify requirements with the relevant embassies or official government sources.

8.3  We accept no liability, and no refund will be given, where a Client is denied boarding, entry, or exit due to incomplete or invalid documentation.

9.  Health, Vaccinations & Fitness to Travel

9.1  Clients are responsible for meeting all health entry requirements, including Yellow Fever vaccination certificates where required, and for obtaining medical advice regarding malaria prophylaxis and other recommended vaccinations well in advance of travel.

9.2  Clients must advise us at the time of booking of any medical condition, disability, reduced mobility, pregnancy, allergy, or dietary requirement that may affect participation. We will make reasonable efforts to accommodate special needs but cannot guarantee the suitability of all itineraries, vehicles, or accommodation.

9.3  Certain activities — including trekking, walking safaris, and balloon flights — carry minimum fitness, age, or health requirements imposed by us or by third-party operators. We reserve the right to decline participation where we reasonably believe an activity poses a risk to the Client or to others, without liability for refund of that activity.

10.  Travel Insurance

10.1  Comprehensive travel insurance is a condition of booking with Afrikan Accent Adventures. All Clients must hold insurance covering, at minimum: medical expenses and emergency evacuation or repatriation; cancellation and curtailment; personal accident; and loss of baggage and personal effects.

10.2  We may request proof of insurance before departure. Clients who travel without adequate insurance do so entirely at their own risk, and the Company shall bear no liability for costs that would otherwise have been insurable.

10.3  We recommend that Clients also confirm coverage for adventure activities where applicable, such as high-altitude trekking, ballooning, and water-based activities.

11.  Acceptance of Risk

11.1  The Client acknowledges that travel in East Africa, and safari travel in particular, involves inherent risks beyond those associated with conventional holidays — including proximity to wild animals, travel on rough roads and in remote areas with limited medical facilities, adverse weather, altitude, and the potential for delays and itinerary changes.

11.2  By booking, the Client voluntarily accepts these inherent risks on behalf of themselves and all members of their party, and agrees to follow at all times the safety instructions of our guides, drivers, camp and lodge staff, park rangers, and activity operators. Failure to follow such instructions is at the Client’s own risk.

11.3  Clients may be required to sign additional waivers or indemnity forms for specific activities operated by third parties.

12.  Liability

12.1  We undertake to arrange your tour with reasonable skill and care.

12.2  Many services forming part of your tour — including accommodation, domestic flights, balloon safaris, and other activities — are provided by independent third-party suppliers under their own terms and conditions, in respect of which we act as agent. We are not liable for the acts, omissions, or negligence of such suppliers or their employees, save where such liability cannot be excluded by law.

12.3  To the fullest extent permitted by the laws of Kenya, our total liability arising out of or in connection with a booking, whether in contract, tort, or otherwise, shall not exceed the total price paid to us for the tour. We shall not be liable for indirect or consequential loss, loss of enjoyment, or loss of opportunity.

12.4  Nothing in these Terms excludes or limits liability for death or personal injury caused by our proven negligence, for fraud, or for any liability that cannot lawfully be excluded.

12.5  Wildlife Disclaimer.  Wildlife sightings can never be guaranteed. No refund or compensation will be given for failure to view specific animals or natural events, including the wildebeest migration.

12.6  Baggage & Valuables.  Baggage and personal effects remain the Client’s responsibility at all times. We are not liable for loss, theft, or damage to luggage or valuables, including items left in vehicles or accommodation.

13.  Client Conduct

13.1  Clients are expected to behave respectfully towards guides, staff, fellow travellers, local communities, and wildlife, and to comply with all park regulations and the laws of the countries visited.

13.2  We reserve the right to terminate, without refund, the arrangements of any Client whose behaviour is, in our reasonable opinion, likely to cause danger, distress, damage, or significant annoyance to others, or who commits an illegal act. In such cases we shall have no further obligation to the Client, who shall bear any resulting costs, including repatriation.

14.  Complaints

14.1  If a problem arises during your tour, you must notify your guide or our office immediately, so that we have the opportunity to resolve it on the spot. Most issues can be resolved quickly when raised at the time.

14.2  If a matter cannot be resolved during the tour, a written complaint must be submitted to us within 28 days of the tour’s end, with full details. Failure to notify us during the tour and within this period may affect our ability to investigate and may reduce or extinguish any claim.

15.  Special Requests

Special requests — such as room type, dietary needs, adjoining rooms, or honeymoon arrangements — will be passed to suppliers but cannot be guaranteed unless confirmed in writing on your Booking Confirmation. Failure to meet an unguaranteed special request shall not constitute a breach of contract.

16.  Children & Minors

16.1  Children are welcome on most of our tours. However, certain lodges, camps, and activities impose minimum age restrictions — gorilla trekking, for example, requires a minimum age of 15, and some walking safaris and balloon flights set their own limits. The Client is responsible for confirming age suitability at the time of booking.

16.2  All minors must be accompanied by a parent or legal guardian, who remains responsible for their supervision and safety throughout the tour. Immigration authorities in the region may require additional documentation for travelling minors, such as birth certificates or consent letters; compliance is the Client’s responsibility.

17.  Photography & Marketing

We may take photographs and video during tours for marketing purposes. Where a Client is identifiable, we will seek consent before use. Clients may decline at any time by notifying us in writing.

18.  Data Protection & Privacy

18.1  We collect and process personal data — including names, passport details, contact information, and health or dietary information — solely to arrange and deliver your travel services, and in accordance with the Data Protection Act, 2019 (Kenya).

18.2  Personal data will be shared with suppliers such as lodges, airlines, park authorities, and permit offices only to the extent necessary to fulfil your booking, and will not be sold or disclosed to third parties for marketing purposes without your consent.

19.  Website & Marketing Materials

We take care to ensure the accuracy of our website, brochures, and itineraries. Descriptions, photographs, and details of facilities are provided in good faith and may change. Obvious errors in pricing or description do not bind the Company, and we reserve the right to correct them.

20.  Severability, Waiver & Entire Agreement

20.1  If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

20.2  No failure or delay by the Company in exercising any right shall constitute a waiver of that right.

20.3  These Terms, together with your Booking Confirmation, invoice, and itinerary, constitute the entire agreement between the Client and the Company and supersede all prior communications.

21.  Governing Law & Jurisdiction

These Terms, and any dispute arising out of or in connection with them, shall be governed by and construed in accordance with the laws of the Republic of Kenya. The parties agree first to attempt to resolve any dispute amicably through good-faith negotiation; failing which, disputes shall be referred to arbitration in Nairobi in accordance with the Arbitration Act (Kenya), or to the exclusive jurisdiction of the courts of Kenya.
